Terms of Service
Superb Maids NYC ("we," "us," or "our") provides cleaning services to clients in New York City, the metropolitan area, and New Jersey. By booking our services, you ("Client") agree to these Terms of Service (TOS).
1. Service Scope & Limitations
1.1 Service Boundaries
We reserve the right to refuse or discontinue services for any reason, including but not limited to:
Discrimination, harassment, or disrespect toward staff.
Health/safety risks (e.g., biohazards, mold, insect infestations, unsafe heights beyond a 3-step ladder).
Inability to access utilities (water, electricity).
1.4 Communication Preferences
By booking services, you consent to receive transactional SMS/text messages (e.g., appointment confirmations, reminders, or updates).
Promotional SMS/text messaging requires separate opt-in consent. Terms, including message frequency and opt-out instructions, are outlined in our Privacy Policy.
2. Liability & Damages
2.1 Insurance Coverage
We cover damage caused by staff negligence. Exclusions:
Normal wear and tear (e.g., carpet snags, aging blinds).
Undisclosed high-value items (artwork, heirlooms >$200).
Improperly installed fixtures or pre-existing damage.
SMS-related issues (e.g., carrier delays, undelivered messages).
Report damage within 24 hours of service for resolution.
3. Privacy & Data Use
3.3 SMS/Text Messaging
SMS/text messages are subject to our Privacy Policy, including "message and data rates may apply" disclosures.
You may opt out of promotional SMS/text messages at any time by replying “STOP.”
4. Cancellations & Fees
Cancellation Policy:
24-hour notice required.
$65 fee applies unless waived due to:
Filled appointment slot.
Documented emergencies (e.g., medical issues).
Payment Terms:
Payment for services is due within 48 hours of service completion. An invoice will be provided upon booking confirmation.
Late payments may incur a 5% monthly fee.
Cancellation Notices:
Cancellations may be communicated via SMS/text message, phone, or email.
5. Non-Solicitation
Clients agree not to hire Superb Maids staff directly for home-related tasks.
SMS/Text Solicitation: Direct solicitation of staff via SMS/text messaging is prohibited.
Solicitation incurs a $5,000 referral/training fee per employee.
6. Indemnification
Clients agree to indemnify Superb Maids, its affiliates, and staff against claims arising from:
Property damage (except staff negligence).
Use of services.
Misuse of SMS/text messaging systems (e.g., unauthorized opt-ins).
Breach of this TOS.
7. Disclaimers
Services are provided “as is” without warranties (express or implied).
SMS Disclaimer: We are not liable for SMS/text message delivery failures, delays, or carrier-related issues.
We disclaim liability for:
Unforeseen risks (e.g., pet injuries, hidden hazards).
Third-party actions.
8. Governing Law & Updates
Governed by New York State law, including compliance with TCPA (Telephone Consumer Protection Act).
Updates to this TOS will be posted on our website and communicated via SMS/text message (if subscribed). Continued use constitutes acceptance.
